Law regulating profession Architects' Act (Act 44 of 2000)
Additional notes Council for the Built Environment Act 43 of 2000 regulates a new umbrella body that will provide a forum for consultation and coordination between the six professional Councils of the Build Environment: Architecture, Landscape Architecture, Engineering, Property Valuers, Project and Construction Management, Quantity Surveying. The respective Acts: 44 (Arch.), 45, 46, 47, 48 and 49 of 2000 are available in pdf format on www.parliament.gov.za.
 
ARCHITECT'S COMPETENCES
Description Design of buildings, structures and installations. Feasibility studies (with QSs), drafting of technical documentation related to the designs, control of construction costs (with QSs), inspection and co-ordination of the construction, design of interiors, furnishings fittings and objects, appraisal services, consulting and technical expertise. Environmental and heritage impact assessment, dispute resolution by means of arbitration & mediation, accessibility audits. Specialist Architect-Planners for urban planning and development, design of urban infrastructure, regional and national planning and inspection and co-ordination of the realisation of the planning projects. Landscape Architects for the landscape design and its realisation.
 
MECHANISM CHECKING LICENSE TO PRACTISE
Description The National Building Regulations Act requires of local authorities to allow only competent persons to submit documentation for approval. The existing regulations (not yet replaced) limited work by others to 500 m2. In accordance with the new legislation and regulations to be finalised, the requirements may be different in future.
 
ARCHITECT'S LIABILITY
Description A) Patent defects 3 years. Latent defects indefinitely. B) 5 years from the date of practical completion of the project.

INSURANCE
Compulsory No
Description The professional indemnity insurance is recommended by the South African Institute of Architects. It is not yet compulsory, but it may be required in terms of new regulations. The Institute's Scheme (APIGIS, Architects Professional Indemnity Group Insurance Scheme) requires 75% SAIA membership of the principals for a practice to be eligible. Several national and international brokerages provide insurance. (SAIAT membership also recognised).

The SAIA strongly recommends that foreign architects form joing ventures / associations with local architects. This would be by way of a formal agreement between the parties/firms concened.
