Description The Limitation Act 1980 states 6 years from cause of action. This depends if the negligence or breach is in contract or in tort. In contract: 6 years from the act. This extends to 12 years if the contract is executed as a deed ("under seal"). In tort: 6 years from the moment when the damage is suffered, without the 12 years provision. The Latent Damage Act 1986 puts a 15 years 'longstop' limit on the above stated from the date of the negligent act (as defined in contract).
